Chapter 5.20   STORMWATER MANAGEMENT AND WATER QUALITY CONTROLS

5.20.010   Statutory authority.

This chapter and regulations are adopted pursuant to the authority and powers granted by the constitution and general assembly of South Carolina, in the act and the regulations.

5.20.020   Title.

This chapter shall be known and may be cited as the "City of Travelers Rest, South Carolina, Stormwater Management and Water Quality Controls Regulations Ordinance" (the "ordinance").

5.20.030   Purposes.

The ordinance codified in this chapter is adopted for the purposes of conducting all activities necessary to carry out the stormwater management programs and other requirements of the county's NPDES permit, the plan, the BMP manual and this chapter.

5.20.040   Jurisdiction.

The provisions of this chapter shall apply to all lands within the incorporated areas of the city.

5.20.050   Adoption and integration of county ordinances.

The council declares its intent to manage the system according to the provisions of the county ordinance then in effect, including specifically the plan and the manual. A copy of the county ordinance, as in effect as of this date, is attached hereto as Exhibit A, is on file in the city clerk's office, and is incorporated as if fully set forth herein.

5.20.060   Management agreement.

The council authorizes its mayor to enter into an agreement on behalf of the city with the implementing organization for the county with respect to the management of the system, such agreement to be substantially in the form attached hereto as Exhibit B, on file in the city clerk's office. The mayor's execution of such agreement shall constitute the council's approval of the final form of this agreement.

5.20.070   Severability.

If any section, subsection, sentence, clause, phrases, or portion of these regulations are for any reason held invalid or unconstitutional by any court of competent jurisdiction, such provision and such holding shall not affect the validity of the remaining portions of this chapter.
