This chapter and regulations are adopted pursuant to the authority and powers granted by the general assembly of South Carolina, in the act and the regulations.

This chapter shall be known and may be cited as the "City of Travelers Rest, South Carolina, Stormwater Management and Sediment Reduction Regulations Ordinance" (the "ordinance").

The ordinance codified in this chapter is adopted for the purposes of (a) implementing a stormwater management and sediment control program to which the commission will delegate permitting and plan review, as well as enforcement as provided for in Section 72-304 of the regulations; and (b) subdelegating such program components to the district, also as provided for in Section 72-304 of the regulations.

The provisions of this chapter shall apply to all lands within the incorporated areas of the city.

5.24.050
The council declares its intent to manage the system according to the provisions of the county ordinance then in effect, including specifically the county's stormwater management design manual (the "manual"), setting forth recommended design procedures and criteria for conducting hydrologic and hydraulic evaluations. A copy of the county ordinance, as in effect as of this date, which is attached hereto as "Exhibit A," is on file in the city clerk's office and is incorporated as if fully set forth herein.

5.24.060
The council declares its intent to request delegation of stormwater and sediment control permitting plan review, and enforcement from the South Carolina Land Resources Commission as provided for in Section 72-304 of the state regulations and authorizes its mayor to take such action as is necessary to request such delegation.

5.24.070
The council authorizes its mayor to enter into an agreement on behalf of the city with the implementing organization for the county with respect to the management of the system, such agreement to be substantially in the form attached hereto as "Exhibit B," is on file in the city clerk's office. The mayor's execution of such agreement shall constitute the council's approval of the final form of this agreement.

If any section, subsection, sentence, clause, phrases, or portion of these regulations are for any reason held invalid or unconstitutional by any court or competent jurisdiction, such provision and such holding shall not affect the validity of the remaining portions of this chapter.
