Chapter 9.20 OFFENSES AGAINST PUBLIC WELFARE
9.20.050 Breach of peace.
It is unlawful for any person to engage in conduct which is
loud, boisterous or disruptive to the peaceable enjoyment, use or occupancy by
others of public places, or surrounding premises, whether public or private.
This prohibition shall apply regardless of whether such places or premises are
actually occupied or in use at the time of the violation, it being the intent of
this section to preserve and protect the peace of the community at all times
against any breach so that such places and premises may always be available for
peaceable enjoyment, use or occupancy. For purposes of this section,
“public place” shall include all streets, sidewalks, parks, schools,
governmental buildings, places of worship, retail establishments, professional
offices, commercial premises of any type, and other places where members of the
public regularly come and go. Prohibited conduct shall not be limited to the
acts of the person, but shall include any acts put into effect by the person
such as loud noises from radios, televisions, phonographs, compact disc players,
or other appliances, as well as the utilization of excessively bright, flashing
lights or the production of obnoxious and putrid fumes. (Ord. O-07-94,
