Article I. General Provisions

3.04.010 Appointment of public works coordinator--Duties--Other personnel.

The administrator may appoint a public works coordinator to superintend the construction and maintenance of streets and perform such other duties as may be required. The public works coordinator shall employ such number of persons to work on the streets as may be needed, subject to the budgetary approval of the council. (Prior code § 3-1-1)

3.04.020 Duty of adjacent property owners to keep sidewalks clear.

It shall be the duty of all owners of real estate within the city to keep the sidewalks adjoining their real estate clear and free from grass; weeds shall be cut and removed therefrom at such times as the council shall direct; provided, that if any owner of real estate within the city shall neglect or refuse to cut the grass and weeds from the sidewalks adjoining his property when directed to do so or fail otherwise to keep such sidewalks clean and sanitary, the chief of police is authorized to employ such labor as may be necessary to clear and clean the sidewalks, and the charge for such work shall be due and payable by such property owner of the property, to be collected as municipal tax. 3.04.030 Designation of one-way streets and alleys.

When any public alley is too narrow to permit vehicles to pass, the chief of police may designate it a one-way alley. The chief of police may designate any street or public alley a one-way street or alley, if, in his opinion, traffic conditions warrant or require such action. (Ord. Article II. Unlawful Acts

3.04.050 Damaging city property.

It is unlawful for any person to mutilate, deface or injure any public property within the corporate limits, any tree, building or other property, or to obstruct any street, alleyway, avenue, bridge, ditch or public road within the corporate limits, and any person found guilty of a violation of this section shall be fined in accordance with Section 1.12.510 of this code. 3.04.060 Games in streets.

It is unlawful for any person to play football, baseball, basketball or other games in or upon any streets, parks, square or any public place, except in the places provided therefor. (Prior code § 3-1-12)

3.04.070 Roller skating.

It is unlawful for any person to skate on or to use roller skates on the public square, streets or sidewalks; provided, that children may skate within the block in which they reside, but they shall not cross the street. There shall be no skating within the business section. (Prior code § 3-1-13)

3.04.080 Draining water or other liquids onto streets or sidewalks prohibited.

It is unlawful for any person to carry water or liquid of any kind, from any store or residence or other building by means of a drain pipe or otherwise, so that the same shall fall or flow upon any part of any street or sidewalk; provided, that sprinkling of a street to lay dust is not forbidden. 3.04.090 Throwing glass, nails, dangerous substances on streets, sidewalks prohibited.

Any person who shall throw or place on any of the streets or sidewalks any glass in any shape or form, tin cans, nails, brick, pieces of iron, sticks or any other obstructions shall be guilty of a misdemeanor. (Prior code § 3-1-15)

3.04.100 Vehicles leaking or scattering load prohibited.

The owner or operator of every cart or other vehicle employed in removing or carrying any dirt, sawdust, sand, coal, material liable to be blown by the wind, or any manure or filth or offensive matter of any kind or description, along or over any of the streets, shall keep the same in such a tight and secure condition that such matter shall not be scattered or permitted to fall on any of the streets. 3.04.110 Vehicles prohibited on sidewalks.

It is unlawful for any person to ride, propel or park any automobile, motorcycle, or other vehicle upon any sidewalk, except as may be necessary in entering or leaving the premises or buildings. (Prior code § 3-1-17)

3.04.120 Breaking, removing street lights.

It is unlawful for any person to break any lamp or electric light or to remove any electric light bulb or otherwise to tamper with any city street lights. (Prior code § 3-1-18)

3.04.130 Breaking, destroying curbing prohibited--Permit required for entrance to property.

It is unlawful for any person to break or destroy the curbing of any street or otherwise deface the same, or to construct any entrance into property on any of the paved streets, unless that person shall have first obtained a permit in writing from the city permits office. (Prior code § 3-1-19)

3.04.140 Vehicles damaging paved surfaces prohibited.

It is unlawful for any person to operate, drive or cause to be driven or operated over, upon or across the paved streets, square or thoroughfare a vehicle having wheels with flanges, ribs, clamps, spikes or other devices attached to or part of the wheel of such vehicle that would injure or damage the paved surface of the streets, square or thoroughfares. 3.04.150 Display of merchandise.

It is unlawful for any person to place any merchandise or other chattels for display upon the streets or sidewalks within the corporate limits. (Prior code § 3-1-21)

3.04.160 Advertisements on streets, sidewalks or public property.

It is unlawful for any person to paint, write, inscribe, place or affix in any manner, or display, any advertising matter inscriptions or devices on the streets or sidewalks, or any property belonging to the city, or to procure the same to be done. (Prior code § 3-1-22)

3.04.170 Responsibility for illegal parking.*

No person shall permit any vehicle registered in his name to stand or park on any street in this city in violation of any of the regulations governing the standing or parking of vehicles. (Prior code § 3-1-23)

3.04.180 Vehicles, animals, and building material obstructing public square, streets or sidewalks.

It is unlawful for any person to ride or drive any animal along any sidewalk or to camp or feed upon the public square or streets or sidewalks, or to leave any vehicle or other article dangerous to the public safety upon the public square, streets or sidewalks, at night, or to make or cause to be made any unreasonable or dangerous obstruction upon the public square, streets or sidewalks. Article III. Excavation and Obstruction

3.04.200 Excavation permit required.

It is unlawful for any person to dig up, mutilate or make an excavation in any paved or clay street or sidewalk for any purpose without a permit from the permits office. (Prior code § 3-1-31)

3.04.210 Danger signals required at excavation.

It is unlawful for any person to allow any trench, ditch or excavation in any street or public place to remain open between sunset and sunrise, unless such trench, ditch, or excavation has a sufficient number of lights properly displayed around it as danger signals to prevent accidents to persons or property. (Prior code § 3-1-32)

3.04.220 Removing danger signals at excavation.

It is unlawful for any person to remove or extinguish any light which may be placed as a signal at night to warn persons of danger from ditches, trenches, building materials, scaffolds, excavations, impediments or obstacles of any description whatsoever in the city. (Prior code § 3-1-33)

3.04.230 Obstruction prohibited.

It is unlawful for any person to place any obstruction upon or cause to be obstructed in any manner any street, sidewalk or public way, or part thereof, so as to render the passage of persons, vehicles or other travel thereon difficult, inconvenient, dangerous, or impossible except as otherwise provided in this chapter; provided, that this section shall not apply to any employee of the city, county or state while such employee is immediately and actively engaged in the maintenance, improvement or construction of any street, sidewalk or public way. 3.04.240 Obstructions to vision at street intersections.*

(a) On corner lots in the city, there shall be no obstruction to vision between a height of two and one-half feet and a height of ten feet measured above the average elevation of the existing surfaces of the intersecting streets at their center line, within the area formed by adjoining points on the property lines measured as follows:
(1) On property lines abutting streets fifty feet or less in right-of-way width, the points on the property lines shall not be less than twenty-five feet from the lot corner.
(2) On property lines abutting streets more than fifty feet in right-of-way width, the points on the property lines shall be fifty feet from the lot corner.
(b) This section shall not apply to buildings in business districts. (Prior code § 3-1-35)

3.04.250 Trees and shrubs obstructing vision.*

It is unlawful to plant, place or cause to grow any tree or shrub on any roadway or street right-of-way or in any area between a sidewalk and a curb of such street or roadway. The chief of police may order the removal of any such tree or shrub already growing in that area upon his determination that such tree or shrub is hazardous to traffic. (Ord.
